NY ethics opinion: Ok to access opponent’s Facebook page

A lawyer representing a client in pending litigation may access the public pages of another party’s social networking website – like Facebook or MySpace – for the purpose of obtaining possible impeachment material for use in the litigation, according to a recent ethics opinion from the New York State Bar Association’s Committee on Professional Ethics.
