A former Hunterdon County, N.J. assistant prosecutor who filed a whistle-blower lawsuit after she was kicked off a pro basketball player’s reckless manslaughter case will be paid $1.3 million.

The U.S. Supreme Court is once again poised to consider when post-conviction relief is available for an alleged failure by prosecutors to disclose exculpatory evidence under Brady v. Maryland.
But the American Bar Association is asking the Court to take a step farther and declare that the duty to disclose goes beyond Brady.

The U.S. Supreme Court has agreed to decide whether prosecutors can be civilly liable for a wrongful conviction and incarceration where they allegedly procured false testimony during a criminal investigation, and then introduced that testimony against the defendant at trial.
