The Department of Justice has decided not to appeal a court decision striking down the Food and Drug Administration’s new graphic warnings on cigarette packages on First Amendment grounds.

The U.S. Supreme Court will not review a $20 million product liability judgment against R.J. Reynolds and Liggett Group, declining the tobacco giants’ invitation to decide whether Florida’s procedures for handling smoker claims violate due process.

Plaintiffs in the ongoing Engle tobacco litigation have scored two consecutive victories.
Jurors in Pensacola County and Highland County, Fla. awarded compensatory and punitive damages to the families of Mattie Ward and Claire Hallgren. Ward’s estate was awarded $2.7 million and Hallgren’s estate received $3.5 million.
