The dischargeability of student loan debt is constitutionally ripe for review before a Chapter 13 debtor receives a discharge or will “imminently” receive a discharge, the 6th Circuit has ruled.
Debt dischargeable in bankruptcy despite fraud

A debt could be discharged in bankruptcy even though it arose from the debtor’s settlement of a state fraud claim, the 1st Circuit Bankruptcy Appellate Panel has ruled in affirming a finding of dischargeability.
